Terms of Service
1. Description of Services
Coach Kai LLC provides coaching services tailored to help you achieve your highest level of success. Services are delivered in the frequency and format specified at the time of purchase. Full payment is required at least 48 hours prior to your first session to secure your spot and receive coaching services.
2. Payment and Refund Policy
Payment for coaching services must be made in full at least 48 hours before the first session. Coach Kai LLC does not offer refunds on coaching services. By purchasing a coaching package, you commit fully to your success. This commitment is essential to the coaching process and ensures that you are fully invested in your journey. Please decide before purchasing that Coach Kai LLC is the right coaching provider for you. Once you commit, it is expected that you are 100% committed, just as I will be for you.
3. Cancellation and Rescheduling Policy
If you need to reschedule a session, you must provide at least 48 hours' notice before the scheduled time. Rescheduled sessions must be completed within one week of the original date. Sessions canceled with less than 48 hours' notice will not be eligible for make-ups. It is crucial that you prioritize these sessions to receive the full benefit of your coaching package.
Session Expiry:
20-session package: Expires within 6 months.
10-session package: Expires within 3 months.
5-session package and The Running Form Program: Expire within 2 months.
4. Force Majeure
Coach Kai LLC shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, fire, strikes, lockouts, natural disasters, or any other events beyond the control of Coach Kai LLC.
5. Limitation of Liability
The client acknowledges and agrees that Coach Kai LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of business, or any other losses arising from the use of its services. This limitation of liability applies irrespective of whether or not Coach Kai LLC has been advised of the possibility of such damages.
6. No Guarantee
Coach Kai LLC does not guarantee specific results or outcomes from the coaching services provided. While Coach Kai LLC is committed to providing professional and high-quality services, the effectiveness of the coaching process depends on various factors, including the client's commitment and participation. No results are promised, and clients should understand that results will vary.
7. Waiver
As part of these Terms and Conditions, clients are required to sign a Waiver of Liability. This waiver releases Coach Kai LLC from any liability for personal injury, accidents, or illnesses (including death), and property loss arising from participation in the coaching program. Clients acknowledge that they have read and understand the waiver and assume all risks associated with the coaching program.
8. Assumption of Risks
By participating in Coach Kai LLC’s coaching programs, clients acknowledge the inherent risks involved, particularly in running and conditioning programs. Clients certify that they are in good health, physically fit, and understand the risks of athletic training, including but not limited to injuries such as sprains, concussions, heat-related conditions, and potentially fatal events. Clients voluntarily assume all such risks.
9. Indemnification and Hold Harmless
Clients agree to indemnify and hold harmless Coach Kai LLC from any claims, actions, suits, or damages, including attorney's fees, arising from their participation in the coaching program. This indemnification extends to any and all claims brought by third parties as a result of the client's involvement in Coach Kai LLC’s services.
10. Severability
If any provision of these Terms and Conditions, including the waiver and assumption of risks, is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
11. Governing Law
These Terms and Conditions, including the waiver, are governed by and construed in accordance with the laws of the State of New York. Any disputes arising under these Terms and Conditions shall be resolved in the courts of New York.
12. Acknowledgment
By purchasing a coaching package or participating in any services provided by Coach Kai LLC, clients acknowledge that they have read, understood, and agreed to these Terms and Conditions. This agreement is binding and enforceable.
Participation in any of Coach Kai LLC’s or Run Coach Kai’s activities requires agreement to the Waiver and Release of Liability.
